Environment and Lands court judge Samuel Ndungu Mukunya died on Friday following an accident along the Nyeri-Nyahururu road.

The judge was involved in a fatal crash on Friday 14th September 2018, morning at Embassy area.

He is said to have been driving towards Mweiga when he hit a Mitsubishi Canter truck after losing control of his vehicle.

Police officers arrived at the scene to access the gravity of the accident.

“Both vehicles were extensively damaged. He died while police were taking him to Nyeri County Referral Hospital. He was alone. We did not identify him immediately. We learned this morning that he was a judge,” stated Nyeri Base Commander Castarais Mugo.

The body was taken to the hospital’s mortuary and later moved to the Outspan Funeral Home.

Justice Mukunya served as a High Court advocate for many years before joining the Judiciary in 2015 during the last recruitment of judges.

He had been moved to Kerugoya after serving at the Bungoma Environment and Lands Court.

Chief Justice David Maraga sent his condolence message describing Mukunya as a personal friend and an outstanding jurist.

Environment and Land Court is one of the Courts contemplated by article 162(2) as a Superior Court just like its counterpart, the Industrial Court. Both have the same status as the High Court.

The court has powers to deal with disputes relating to land administration and management.

The court is also empowered to hear cases relating to public, private and community land and contracts, chose in action or other instruments granting any enforceable interests in land.

The court also exercises appellate jurisdiction over the decisions of subordinate courts or local tribunals in respect of matters falling within the jurisdiction of the Court.

Justice Mukunya becomes the second judge to pass on a month after another died after collapsing.

High Court Judge Louis Ongutu collapsed and died at the Parklands Sports Club in Nairobi.

The commercial division Judge was rushed to MP Shah Hospital where he was pronounced dead on arrival.

The report was confirmed by Kenya Judges and Magistrates Association Secretary General Derrick Kuto who stated that Justice Ogutu passed on after a gym session.
